BANDITK9 Dog Training Results & Liability Disclaimer

This Dog Training Results & Liability Disclaimer ("Disclaimer") applies whenever you engage BANDITK9, operated by ROSARIO FERRO (ABN 43 182 731 266), a sole trader business based in Western Australia ("BANDITK9", "we", "us" or "our"), to provide dog training services, including one-on-one training, group sessions, training packages, consultations, or any other service described by us as dog training or behaviour training (the "Services").

By booking or participating in our Services, you acknowledge that you have read and understood this Disclaimer and agree to comply with the responsibilities described in it.

This Disclaimer should be read together with our Website Terms of Use and Cancellation & Booking Policy, as well as any other policies or terms that apply to the Services.

Nothing in this Disclaimer excludes, restricts, or modifies any right, guarantee, remedy, or protection available to you under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded, restricted, or modified.

1. Nature of Services & No Guaranteed Outcomes
Dog training and behaviour modification involve living animals and are inherently unpredictable. Our service fees cover the provision of our professional time, skill, advice, and training techniques during your sessions.

While BANDITK9 uses professional experience, training knowledge, and methods appropriate for the individual dog and circumstances, we do not guarantee:
-
a specific training result or permanent behavioural change;
-
the complete elimination of a particular behaviour;
-
a specific level of obedience or an exact timeframe for improvement; or
-
that a dog will respond in a specific way to a training method or program.
Any specific outcome will only be considered guaranteed where BANDITK9 has expressly agreed to that outcome in writing.
Training results are dependent on numerous variables outside our control, including:
-
the dog's individual temperament, age, genetics, and health;
-
prior history, trauma, or undisclosed behavioural issues;
-
the dog's home environment and social exposure;
-
consistency of handling, reinforcement, and homework completed by you between sessions; and
-
underlying medical conditions.
Progress made during a session may change or regress if training routines and boundaries are not consistently maintained.

2. Individualised Training & Adaptation
Training recommendations are based on our observations and the information provided to us at the time.
We reserve the right to modify, pause, or alter training exercises, equipment, or techniques where we reasonably consider it necessary for the welfare of the dog or the safety of any person or animal. Recommendations made during one session may become unsuitable if your dog's health, behaviour, or environment changes. You agree to notify us promptly of any such changes.

3. Inherent Risks of Working with Dogs
Working with and handling dogs involves inherent risks that cannot be entirely eliminated, even when using professional precautions and proper handling techniques.

These inherent risks include, but are not limited to:
-
bites, scratches, jumping, or sudden pulling on leads;
-
trips, falls, and handler injuries;
-
unexpected interactions between animals;
-
property damage; or
-
a dog escaping or running off.
By participating in the Services, you acknowledge these inherent operational risks. Nothing in this section limits any legal responsibility or duty of care that BANDITK9 owes to you under applicable law.

4. Client Responsibilities & Disclosure
You are responsible for providing accurate, full, and honest information regarding your dog prior to and during the Services. This includes disclosing:
-
known medical conditions, injuries, or pain;
-
behavioural history, including fear, anxiety, or reactivity;
-
previous bite incidents, aggression, or known triggers; and
-
medications or ongoing treatments.
You must not intentionally withhold information relevant to safety.
While participating in the Services, you are responsible for:
-
following all reasonable safety instructions provided by BANDITK9;
-
maintaining direct control of your dog whenever it is not being handled by BANDITK9;
-
using safe, functional equipment as instructed;
-
supervising your dog and any accompanying guests or children at all times (children must remain under direct adult supervision); and
-
taking reasonable steps to prevent your dog from causing harm or damage.
5. Health, Illness, and Vaccinations
You must not bring a dog to a session if it shows signs of a contagious illness or condition that puts other animals or people at risk.
Please inform us immediately if your dog displays illness, injury, acute pain, or sudden severe behavioural shifts. BANDITK9 reserves the right to postpone or modify a session if we reasonably believe a dog is unfit to participate safely. You are responsible for ensuring your dog complies with local council registration and vaccination requirements appropriate for the training environment.

6. Training Tools & Equipment
BANDITK9 may recommend or utilize various tools (e.g., standard leads, long lines, harnesses, muzzles, reward toys, food rewards, or specific collars) tailored to your dog's needs.
All equipment must be used strictly as instructed. You are responsible for inspecting your own equipment prior to use and discontinuing use if it appears damaged or unsafe. Nothing in this section limits any non-excludable statutory guarantees applying to goods or equipment supplied directly by BANDITK9.

7. Media, Photography, and Video
BANDITK9 may take photos or video during training sessions for internal training records, educational content, marketing, website use, or social media. If you do not want your or your dog’s identifiable image or video used for public promotional purposes, please let us know before your session. We will respect your request. Opting out of public promotional media does not prevent BANDITK9 from keeping internal records where reasonably required for training, legal, safety, or business purposes.
8. Safety & Session Management
BANDITK9 reserves the right to pause, alter, or immediately terminate a session if we determine that continuing poses an unreasonable safety or welfare risk (e.g., undisclosed aggression, unsafe handling, severe distress, or hazardous environmental conditions).
Where practical, we will explain the reason for stopping the session and discuss alternative options. Applicable rescheduling or cancellation fees are governed by our Cancellation & Booking Policy.

9. Conduct Outside Direct Supervision
BANDITK9 provides instruction to help you train and handle your dog effectively. We are not responsible for your dog's behaviour when the dog is outside our direct supervision, including at home, in public, or when recommendations are implemented without appropriate oversight. Training guidance does not replace your ongoing legal responsibility as an owner to supervise and manage your dog.

10. Limitation of Liability
To the maximum extent permitted by law, BANDITK9 is not liable for any indirect, incidental, or consequential loss, injury, or damage arising from the inherent risks of handling animals or events beyond our reasonable control.
However, nothing in this Disclaimer excludes or limits BANDITK9's liability for loss, damage, or injury to the extent caused by our negligence, wilful misconduct, or breach of a non-excludable statutory standard under Australian law.
11. Australian Consumer Law (ACL)
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in this Disclaimer purports to exclude, restrict, or modify any statutory consumer rights you hold that cannot be lawfully excluded. Where the ACL permits us to limit our liability for a breach of a consumer guarantee, our liability is limited to the resupply of the Services or the payment of the cost of having the Services supplied again.

12. No Medical or Veterinary Advice
BANDITK9 offers dog behaviour and training instruction only. We do not provide veterinary or medical advice. If your dog's behaviour may be caused or aggravated by pain, illness, or a medical condition, we strongly advise consulting a qualified veterinarian. Training should never be used as a substitute for veterinary care.

13. Governing Law
This Disclaimer is governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia regarding any dispute connected to this Disclaimer or our Services.
